SIR: It is to be hoped that the 'top legal expert' called for by Mark Perks in respect of Red Moss Supertip turns out to be just that, and not first a junior counsel and later a planning lawyer instead of one skilled in land law.
Terry Adams Ltd. believe that the unitary development plan inquiry inspector failed to take its evidence into account re Red Moss and, obviously, having the financial backing to challenge what they see as an injustice are pressing ahead with an objection. I, too, am of the opinion that the inspector did not take seriously enough the vital information that Birtenshaw farmland was not allocated for development on the draft U.D.Ps because of the Covenant (acknowledged by the planners) but was subsequently designated as such in spite of the fact that the restrictive document was proved in court to be legally binding. It is interesting to note that a council spokesman said re Red Moss: "The legal action would not stop the authority looking at the application to develop the site." This is exactly what they said about Birtenshaw and the rest is history!
