CAN someone please advise me on present day planning law? When planning applications are allowed subject to certain conditions, for how long do those conditions apply? Is it 40 years, 40 months or 40 minutes?
A planning application was allowed, subject to the condition that the land became park land, for tipping at Singing Clough, Kearsley. The Kearsley Council even built old people's flats nearby and called them Park View.
The Bolton Planning Authority now wants to turn the land over to an industrial unit, and a public enquiry is due shortly. The Kearsley residents nearby put up with smells, insects, traffic problems, loss of leisure land etc, knowing that park land was to follow.
If our local planners ignore planning decisions and public opinion, what is the point in a council planning committee?
Perhaps it is a case for the Ombudsman.
