A 17-YEAR-OLD drunken youth who hit an innocent man in the face with a bottle has lost an appeal against a four month custody sentence. The unprovoked attack happened after Harry Percival and members of his family had left the Flying Shuttle pub in Farnworth to make their way to a nearby chip shop.
The 17-year-old defendant, who was drunk and with a gang of six others, shouted abuse at one member of the Percival party as they entered the chip shop but was dragged away by friends.
Then abuse continued as they left the shop and Mr Percival went to have word with them saying they did not want any trouble.
Without saying anything the youth hit Mr Percival with the bottle and then ran off.
The youth appeared at Bolton Crown Court to appeal against a four month Detention and Training Order imposed by Bolton Magistrates.
Recorder Clement Goldstone QC, sitting with two magistrates, threw the appeal out saying that they agreed with the magistrates that violence outside fast food outlets should not be tolerated.
