The owner of a restaurant in Bolton did not comply with planing conditions  when a shop was turned into a restaurant court heard.

Phull Pervez, of Green Lane, Great Lever, pleaded guilty to two charges of failing to comply with conditions of a planning permission at Bolton Magistrates Court on Monday (January 30).

Pervez submitted a planning application in 2018 for his shop to be turned into a restaurant, which is now Bolton Kohinoor Restaurant on Derby Street.

The court heard how Bolton Council had approved his plans on two conditions in August 2018.

The first condition was to have a noise assessment carried out to ensure the restaurant was not too loud for neighbours.

The second was to submit details to the council regarding extraction of fumes and smells from the restaurant.

However, Pervez failed to carry out the tasks before the deadline of September 9 2020.

Prosecutor Cavaney told the court: “A local enforcement team have tried to get the defendant to comply with informal attempts, however to date neither condition has been complied with.”

Speaking through a translator, Mr Purvez said in court that the letters telling him to comply with the conditions were sent to a former address where he no longer lived.

On being asked when he found out about the two conditions, he said: “When the communications were sent to my new address, this is when I found out. Six to seven months ago.”

Chair Janet Greatbanks asked Mr Purvez: “And have these conditions been complied with now you have been aware of it for six to seven months?”

He replied: “It has not been done so far, but I am getting to do it.”

However, Prosecutor Cavaney said: “He was hand delivered (the conditions) on 6 August 2020.”

In conclusion, Ms Greatbanks said: “We have listened very carefully to Bolton Council and yourself and your explanation.

“You have pleaded guilty to two offences of failing to comply with the conditions that were attached to your planning permission.”

He was fined £700 for the offences, £350 for each one, £715 in costs, and a victim surcharge of £70, to be paid in instalments for the next three months.

It was also specified that for each day from January 31 onwards that he doesn’t begin to follow the conditions, a new offence and a fine of £100 will accrue.
