A Greater Manchester Police constable who assaulted a member of the public after a night out was dismissed from the force.

Jakub Mielczareck 'drank an excessive amount of alcohol' then 'kicked a member of public in the chest', a tribunal was told.

On January 18, around a month after the incident, PC Mielczareck was issued with an adult caution for common assault, although he avoided a criminal conviction.

And on November 18, his case was considered Chief Constable Stephen Watson.

PC Mielczareck was in attendance at Greater Manchester Police HQ, where he agreed his actions amounted to misconduct.

He apologised, which the Chief Constable accepted, but this misconduct was still considered to be of the utmost seriousness.

Chief Constable Watson said: "His actions were deliberate albeit unplanned and, whilst he was clearly severely intoxicated, were carried out in the full knowledge that his conduct was both patently unlawful and of the character that, by definition, posed a danger to another. 

"His conduct inevitably brings the profession into disrepute, and undoubtedly damages the confidence the public might otherwise wish to place in their police officers."

The Chief Constable received a number of references which were 'clear and consistent' in their support of PC Mielczareck, and he suggested the constable was 'open and honest' over the course of the case.

However, PC Mielczareck was dismissed from the force with immediate effect.

Chief Constable Watson said: "What is clear to me is this episode marks a terrible lapse in judgement which flies in the face of the evidence provided, which is to suggest PC Mielczareck is an otherwise decent and hardworking officer who had shown significant early potential. 

"It remains clear, however, that all of these positive personal attributes do not outweigh the potential for the loss of confidence that would ensue if he were to be permitted to continue to perform in the office of constable. Regrettably, therefore, I have determined the appropriate outcome in this case is PC Mielczareck should be dismissed from the service with immediate effect."

The constable was placed on the College of Policing's barred list, where he remains unless he succeeds in a review application.

He cannot start a review application for a minimum of five years.
