A TEENAGER who raped a 12-year-old boy has been jailed for three years.
Jordan Smiley, of Greenfold Avenue in Farnworth, was just 16-years-old when he committed the offence.
He was sentenced at Bolton Crown Court yesterday after pleading guilty at a previous hearing.
Steven Wild prosecuting told the court how Smiley and his victim were at a house on October 26 2015 and had been drinking alcohol and smoking cannabis.
The boy started falling asleep before Smiley pinned him down and carried out the attack.
The boy asked Smiley to stop, saying that he ‘didn’t want him to do that’ and ‘begged him to stop’.
The next day he told his mother what had happened and she reported it to the police.
In a statement the victim’s mother said: “When he told me what had happened to him I was devastated.
“I felt like I had let him down, I felt like I had not protected him.
“Jordan Smiley has taken away his innocence, his childhood was tossed away. I can’t express how angry I am towards Jordan Smiley.”
Nicola Gatto, defending Smiley, said that there is no doubt that this was a ‘deeply unhappy and traumatic incident’ and that he recognises the seriousness of it.
She added that he wishes to convey his apologies for what happened.
Miss Gatto also spoke about the defendants own problems.
She said that he suffers from ADHD, clinical anxiety and Aspergers syndrome as well as having mild learning difficulties.
Miss Gatto, added that the Aspergers means he struggles to empathise with other people.
Judge Richard Gioserano said that a psychologist had found that it is possible that Smiley, who is now aged 18, did not act callously but was not able to realise the effect of what he was doing.
However, he added that this makes the harm Smiley has caused ‘no less real’.
Speaking about the victim’s mother, Judge Gioserano said: “She feels that you should receive a long prison sentence. No matter how long a sentence it may be it will not repair the damage you have done."
Judge Gioserano added that only time will tell the extent of the damage done to the victim.
He added that the use of physical harm aggravated matters and that Smiley knows how wrong what he did was and that he ‘held him down and he pleaded with you to stop’.
If Smiley had been an adult when he carried out the offence he would have faced a longer sentence but Judge Gioserano was able to reduce it due to his age.
Smiley was sentenced to three years in a young offenders institute and was placed on the sex offenders register for life.
