A FIGHT against a 40ft phone mast installed despite being refused planning permission will tomorrow be stepped up as Bolton Council serve an enforcement notice.
The council will post the notice to T-Mobile requring the firm to remove the mast from the Market Street precinct in Little Lever within 28 days.
It was put up on Sunday despite a decision by the council's planning committee in April to reject the application.
The council's move comes after company agents refused to remove the mast voluntarily.
If the company ignores the enforcement notice a Government inspector is likely to decide whether the mast can remain at a public inquiry.
T-Mobile claims the council failed to follow guidelines requiring it to notify the company of the planning committee's decision within 56 days of the application being submitted.
The council denies the allegation and planning committee chairman and local councillor Sean Hornby has organised a protest at the site of the mast at 2pm on Friday.
